Rights and Obligations of the Parties

1. What are the rights and obligations of the Petitioner?

1. To propose a petition for the nullity of his or her previous marriage to the Tribunal.
2. To propose the claim on which the alleged nullity of the marriage is based.
3. To propose witnesses and other forms of proofs (e.g., documents) in support of the claim.
4. To answer questions put to him or her by the judge and to tell the whole truth. 
5. To be informed of the name of the judge and of the other Tribunal officials assigned to the case.
6. To know the canonical grounds on which the judge has decided to adjudicate the case.
7. To propose other grounds or oppose the grounds proposed in the case by the judge.
8. To be notified of any change of the grounds in the case.
9. To review the information gathered in the case not already known to him or her.
10. To respond, if he or she chooses, to the information reviewed in the case.
11. To nominate a procurator who will represent him or her in the case and who will advise him or her.
12. To be informed of the status of the case.
13. To read the decision of the judge regarding the case at the Tribunal.
14. To appeal the final decision of the Tribunal, if he or she is dissatisfied with the decision. 
15. To renounce the petition, provided that the respondent does not object and the judge agrees to grant the renunciation.

2. What are the rights and obligations of the Respondent?

1. To be notified of the petition and of the claim of the petitioner.
2. To agree or disagree with the claim on which the petitioner has alleged the marriage to be invalid.
3. To participate in the process.
4. To answer questions put to him or her by the judge and to tell the whole truth. 
5. To be informed of the name of the judge and of the other Tribunal officials assigned to the case.
6. To know the canonical grounds on which the case will be adjudicated by the judge.
7. To propose other grounds or oppose the grounds proposed in the case by the judge.
8. To be informed of any change of the grounds in the case.
9. To propose witnesses and other forms of evidence (e.g., documents) to prove or disprove the claim of the petitioner.
10. To review at this or another Tribunal the information gathered in the case not already known to the respondent.
11. To respond, if he or she chooses, to the information reviewed in the case.
12. To nominate a procurator or an advocate to represent him or her in the case.
13. To be informed of the status of the case.
14. To read the decision of the judge regarding the case at the Tribunal.
15. To appeal the decision if aggrieved by it.
